At Right Media, we respect the intellectual property rights of creators while maximizing the protection of our clients' commercial and legal interests. This policy clearly defines intellectual property rights, copyright, and commercial exploitation rights for film production, TV commercials, and other media publications produced by Right Media.
By accessing the Right Media website or using its services, you agree to the terms of this Policy.
1. Copyright for the content on the Right Media website.
All content displayed on the website (including but not limited to: text, images, demo videos, logos, interface design, source code, graphics, audio, and other materials) is the property of Right Media or is legally licensed for use by Right Media.
Any copying, reproduction, distribution, modification, publication, commercialization, or use of the website content in any form without the written consent of Right Media is strictly prohibited, except where permitted by law (e.g., short quotations for informational, research, non-commercial purposes with proper attribution).
2. Intellectual property rights for products produced by Right Media
2.1. Before full payment
- All copyrights, related rights, and other intellectual property rights to the product (TV commercials, corporate videos, short films, animation, motion graphics, etc.) belong to Right Media.
- Customers may only use the product for internal review purposes and may not disclose, distribute, or use it commercially until payment obligations are fulfilled.
2.2. After full payment
- After the client has paid the full contract value (including any additional costs agreed upon by both parties), Right Media transfers to the client the right to use the product within the scope agreed upon in the contract (usually including the right to use, copy, distribute, and publish on the specified platforms).
- Unless otherwise agreed in writing, the right to transfer to the client is non-exclusive and may be limited in terms of time, territory, or form of use depending on the specific contract.
- Right Media retains the right to retain the original project files and related documents for archiving, maintenance, and technical support purposes (if any).
2.3. Right Media's Portfolio Usage Rights
- Unless the client requests absolute confidentiality in writing and both parties have agreed beforehand, Right Media has the right to use the completed product (in whole or in part) to showcase its capabilities on its website, social media, marketing materials, pitch deck, and other media channels.
- This use does not affect the customer's right to use the service.
3. Documents provided by the client
The customer commits and guarantees that:
- All materials, images, logos, music, scripts, actors, settings, and other content provided by the client are the legal property of the client or the client has been granted full permission to use them.
- The use of these materials in the product does not infringe on copyright, related rights, industrial property rights, or any third-party rights.
Clients are solely responsible for any legal liability and compensation for damages (if any) arising from the use of materials provided by them. Right Media reserves the right to refuse use or request clients to provide documentation proving legal right to use the materials if any infringement is detected.
4. Third-party documents
In cases where the product uses images, videos, music, fonts, or resources from third parties:
- Right Media will use resources with valid commercial licenses in accordance with the agreed-upon purposes.
- The cost of purchasing the license (if incurred and approved by the client) will be included in the total contract value or paid separately as agreed.
- Access to these resources is subject to the provider's license terms. Customers must comply with any restrictions (if any) specified in the contract or its appendix.
5. Prohibited behaviors
Customers and website users are not allowed to:
- Copying, modifying, or redistributing Right Media's products without the transfer of rights or exceeding the agreed scope;
- Remove, obscure, or alter copyright information, watermarks, or product origin markings;
- Using the product for illegal purposes, violating public morals, or causing damage to Right Media and third parties;
- False claims about product ownership.
6. Handling copyright infringement
Upon discovering any infringement of intellectual property rights, Right Media has the right to:
- We demand an end to the infringing behavior.
- Request the removal of infringing content.
- Claim for damages in accordance with the law and the contract.
- Take necessary legal measures to protect your legitimate rights and interests.
7. Complaints regarding copyright and intellectual property infringement.
If you believe that content on Right Media's website or products published by Right Media infringes your legitimate intellectual property rights, you may submit a complaint notice to Right Media with the following minimum information: complainant's information; evidence proving ownership or legitimate right to use; description of the alleged infringing content; links or related documents; request for action; and a commitment to the accuracy of the information provided.
After receiving all the necessary information, Right Media will review, verify, and respond within a reasonable timeframe. Depending on the case, Right Media may temporarily hide, remove, restrict access, or request additional verification documents before making a decision. Establishing a point of contact for receiving and processing feedback/complaints is consistent with the requirements for transparency and protecting the rights of service users.
8. Resolving copyright infringement disputes
Any use of Right Media's products, scripts, or ideas before full contract payment is completed, or for purposes other than those agreed upon, will be considered a violation of intellectual property rights.
In the event of a dispute, both parties prioritize resolution through negotiation and mediation. If a common ground cannot be reached, the case will be referred to the competent authority for resolution in accordance with the laws of the Socialist Republic of Vietnam.
9. Limitation of Right Media's Liability
Right Media is not responsible for violations arising from customers' misuse of the product, unauthorized modification or alteration of the publication context, combination with illegal content, unauthorized use of property, or continued use of the product after the license has expired or in the event of unresolved disputes.
Right Media is also not responsible for copyright, trademark, image rights, personal data rights, or related rights disputes arising from client-provided assets, unless the fault lies entirely with Right Media.
In all cases, if Right Media is liable for compensation, its maximum liability, unless otherwise stipulated by law, shall not exceed the total value of services actually paid by the client for the item directly related to the dispute.
